Summary: Requires private postsecondary schools to provide prospective students with a School Performance Fact Sheet, which would include the institution's net price calculator and the average student loan debt of graduates of the institution if the institution receives federal funding.

Outlook: The Committee on Appropriations will accept limited public testimony during the January 23 hearing when a vote on this measure is expected at the hearing. Should the Committee determine this measure has a significant fiscal impact, it may place this measure in its suspense file for consideration at a later time. If the Committee deems the measure does not have a significant impact it will pass the measure and send it to the Floor for a second reading.

During the January meeting of the Assembly Higher Education Committee this measure was passed by a 9-2 vote with two members not voting. The California Federation of Teacher and the California State Student Association registered in support of the measure arguing that it was valuable to providing prospective students with information and tools to gauge college affordability when making informed financial and education decisions. Registering in opposition to the measure were the American River College/West Coast University, California Association of Private Postsecondary Schools, California Coalition of Accredited Career Schools and the University of Phoenix. Those arguing in opposition to the measure pointed to disclosure regulations passed last session that schools are still struggling to implement as a reason why additional regulations should not be presented at this time. The University of Phoenix and the California Coalition of Accredited Career Schools expressed their mild support if amendments were added to conform the disclosure requirements to those required by the U.S. Department of Education's Postsecondary Education Data System to eliminate duplicative and costly data gathering requirements and limit confusion for students.

This measure will next be referred to the Assembly Committee on Appropriations for consideration. As this measure contains fiscal provisions it must be approved by the Appropriations Committee before it may be considered by the full chamber. Per Joint Rule 61(a)(5), the committee has until May 27 to act on this measure.

This measure was removed from the January 7 Assembly Higher Education Committee meeting agenda and added to the Committee's January 14 meeting agenda. The measure will be one of four other measures being heard by the Committee relating to funding of educational programs. The hearing will be open to the public and testimony will be accepted. A vote is at the discretion of the Committee chair, Assembly Member Das Williams (D).

This measure failed to meet the committee reporting deadline and will not be considered further during this legislative session. The bill will be eligible for consideration during the 2014 legislative session.

By rule, this measure cannot be heard in committee until 30 days have passed since its introduction. The sponsor is a member of the majority party and has not garnered any cosponsors. Democrats control both legislative chambers and the Governor's office.
