Summary: Current version (4/22/2014): Prohibits the Department of Health Care Services from approving an organization for those purposes that does not prior to registering or certifying a counselor, consult with the available electronic databases of certain other approved counselor certifying organizations to determine whether the person, working within alcoholism or drug abuse recovery and treatment programs, has ever had his or her registration or certification as a counselor revoked.

This measure passed the Committee on Health, 18-0-1, and was referred to the Committee on Appropriations. During the hearing, the Committee adopted an amendment, which the requires the Department of Health Care Services to design its death investigation policy to ensure that the death of a resident of a licensed facility is reported by the licensee and addressed by the Department in a timely manner. The California Association of Addiction Recovery Resources and the California Narcotic Officers’ Association support this measure. There is no registered opposition on file.
The April 8 amendment requires that, prior to registering or certifying a counselor, the certifying organization consult with the available electronic databases of certain other approved counselor certifying organizations to determine whether the person has ever had their registration as a counselor revoked.
According to the author, this bill is intended to ensure that a resident’s death is promptly reported by an alcoholism and drug abuse recovery or treatment facility and addressed by the Department of Health Care Services in a timely manner.
The sponsor is a member of the minority party. Democrats control both chambers of the Legislature as well as the office of the Governor.
